DOVER, Del. (AP) - A former Delaware death row inmate, who was acquitted of all charges after being retried for a drug-related killing, is suing current and former state officials.

In a federal lawsuit filed late last week, Isaiah McCoy claims he was wrongfully and maliciously investigated, prosecuted and incarcerated.

McCoy also claims state police and prosecutors knew or should have known he was innocent of the 2010 murder of James Munford, but nevertheless investigated and prosecuted him.

The high court ruled that a lower court judge had erred when he ordered prison officials to move him out of solitary confinement.

His attorney had argued that the 5 years in solitary confinement had affected his mental state and was hindering his participation in preparing for his upcoming retrial.

DOVER, Del. (AP) - Delaware's Supreme Court is weighing whether to overturn a judge's order transferring a former death row inmate who is awaiting retrial from maximum security to the general prison population.

The judge ordered Isaiah McCoy transferred last year after his lawyer said McCoy was being denied access to the law library and was unable to meet privately with his lawyer outside the presence of prison guards.

Former death row inmate Isaiah McCoy will be able to privately meet with his attorney.

That assurance came after his lawyer complained he was being denied access to his client without a correctional officer being present.

The Wilmington News Journal reports that Herbert Mondros wrote in a letter to the judge saying that this was no way to prepare for a murder trial.

After this week’s hearing Mondros said this will now allow him a better opportunity to prepare the case with his client.
