Delaware AG Appeals Changes in du Pont Trust for Children's Hospital

Delaware Attorney General Beau Biden has filed an appeal in Florida’s First District Court of Appeal that seeks to challenge changes to the Florida-based Alfred I. du Pont Trust that he says hurts the First State.

The Wilmington News Journal reports that the appeal to overturn the September decision was filed on Friday.

Biden says that the changes were made without proper notice to his state.

The ruling would bar Biden from re-opening a 2004 reorganization of the trust that provides funds for the Alfred I. du Pont Hospital for Children in Wilmington.

The changes would water down the role that Delaware residents play when the trust spends funds through the Nemours Foundation in Florida.

The News Journal reports that Trust Chair Hugh Durden called the appeal “unfortunate and avoidable” since funds would be spent on legal bills rather than care for the children – most of whom are in Delaware.
